Just a question, Sini, because I honestly don't know. Do they get these permits under the freedom of speech or the freedom of assembly, or does it matter since all fall under the same amendment?

Both probably since both are 1st Amendment related. The thing that gets me is that the government can put reasonable time, place, and manner restrictions on protests and assemblies as long as they are applied equally to everyone. I would think not being allowed to protest during a funeral would be a reasonable time restriction. If they want to protest against homosexuality, I'm sure they can do it some time other than when a person is laying a loved one to rest.
