Most companies lose in small claims courts, because company policy is not law. Mr. Frenzy used to work for a small business, and in the collective years of all the small claims court cases they had to go to, they only won once. Most judges just rule for the plaintiffs because businesses can take it and they're just out to make a buck off the little guy anyway.

Man I wish we had Arbys in Vermont...however we're so anti-business that its taken Walmart 15 years to even get a permit to build and its still being appealed...I look at that as a good thing overall.

And second, the cups for every fast food chain are the same all across the country and they're all either paper or styrofoam (with the exception of Taco Bell's large, which is light plastic). Arby's are paper. The manager could tell they hadn't eaten at Arby's in awhile based on the state of the cups. They get battered pretty easily and it doesn't take long before they get to the state that no sane person would want to use them.

And third, they were in the drive-thru. No one was going to step up behind them and demand anything, because there is no stepping involved and they wouldn't be able to see what was going on anyway on the off chance that they were really paying attention.

And, saving the best for last, yks, I've been trying to say that that was what's really ridiculous. It angers me that we would rather just accept racism than try to eliminate it. And, yeah, that's what I see that as doing.

Actually that depends on size. Most of the large cups that fastfood gives out now are made of plastic that can last awhile.

And how is caving to threats based upon racism and giving them free drinks any different than the policy you're up in arms against? They both seem like accomodating racism instead of fighting it to me.

Most racial discrimination claims are heard outside of small claims courts (either federal or state district courts) simply because most of the plaintiffs shoot for the moon on damages.

Okay. They're all either styrofoam, paper or the same light plastic as Taco Bell's. But none of those actually last long. The plastic obviously lasts awhile longer, but still, it breaks really easily. RS and I's dad used to try to save them to just use at home. It didn't work out. And, personally, I'd be caving to laziness, not the threat of a racial discrimination lawsuit. I doubt that'd even have occurred to me. I don't go around thinking, "I better do this so I don't get sued." I go around thinking, "I can just give it to him and then I don't even have to go through the effort of thinking about it," or, really, "Just give it to him; I don't care if they're too lazy to walk their ass inside."

Yes, I'm too lazy to care whether people walk inside for a free refill or try and get it at the drive-thru window. And apparently this is a bigger problem than making sure management is multi-racial at all times.

Managers often have the right to make decisions that may go against one established company policy because there is another company policy that says, "the Manager can choose, depending on the situation, to give a client a free lunch, even when the company policy says no free lunches". Which is why, when you think you have been wronged and some peon on the phone tells you that he can't help you, you say, "can I talk to your manager?".

Your sarcasm Tam is pretty good up until the point you consider the legal precedent you are setting in allowing someone to threaten their way into obtaining free goods and services. If the policy that Arby's adopts is to give away free drinks to anyone who makes a fuss or threatens Arby's with suit, then at some point, someone will eventually sue over that policy because maybe they didn't their free drink and win against Arby's because it is their own policy. Then it becomes a matter of case precedent which is just as good as legislated law in lot of instances. What you are essentially doing is legalizing blackmail, which, last time I checked, was still a crime.

If they had threatened their way into obtaining free goods, at the moment of service, then I would be agreeing with you that the Manager made the right call. As far as I read it, they kept asking up the management chain and then they got upset and then left. Weeks later Arby's was sued.
